Term Conditions

1. Eligibility & Account Registration

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use this Site.
• You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential.
• VKERT reserves the right to suspend or terminate accounts containing false or misleading information.

2. Use of the Site

• You agree to use the Site only for lawful purposes and in accordance with these Terms.
• You may not use the Site to engage in fraudulent activity, misrepresentation, intellectual-property infringement, spamming, or any action that could damage VKERT or its users.
• You are responsible for all activity that occurs under your account.

3. Products, Pricing & Availability

• All products, prices, and offers on VKERT are subject to availability and change without notice.
• VKERT reserves the right to modify, limit, or discontinue any product or promotion at any time.
• While we strive for accuracy, product descriptions, colors, and images may vary slightly from actual items.

4. Orders, Payment & Fulfillment

• Placing an order constitutes an offer to purchase; VKERT reserves the right to accept or decline any order.
• All payments must be processed through approved payment methods displayed at checkout.
• Orders are fulfilled in accordance with our Shipping Policy and may be handled directly by VKERT or authorized fulfillment partners.

5. Seller Services

• If you register as a seller, you must comply with these Terms and the VKERT Seller Policy.
• Each seller account is subject to review, verification, and eligibility checks.
• VKERT grants every verified seller a $5,000 purchase credit to list inventory from the master catalog.
• You understand and agree that 5 % of each sale is automatically contributed to VKERT’s Shared Advertising Fund, which promotes all sellers collectively.

6. Returns & Refunds

• Returns and refunds are governed by our Return Policy.
• Unless otherwise specified, approved refunds are credited to the original payment method.
• VKERT reserves the right to refuse returns that do not meet policy conditions.

7. Intellectual Property

• All content on the Site — including text, graphics, logos, images, videos, software, and trademarks — is the property of VKERT Inc. or its licensors and protected under U.S. and international intellectual-property laws.
• You may not reproduce, distribute, or exploit any VKERT content without prior written consent.
• By submitting content (such as reviews or store materials), you grant VKERT a non-exclusive, royalty-free license to display and use that content for promotional purposes.

8. Disclaimers & Limitation of Liability

• The Site, its content, and all products are provided on an “as-is” and “as-available” basis without any warranty, express or implied.
• VKERT does not guarantee uninterrupted service, error-free content, or that the Site will be free from viruses or other harmful components.
• To the fullest extent permitted by law, VKERT, its affiliates, officers, and employees shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to your use of the Site or products purchased.

9. Indemnification

You agree to defend, indemnify, and hold harmless VKERT Inc., its affiliates, employees, and agents from and against any claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising from:

• your use of the Site;
• any breach of these Terms; or
• violation of any law or third-party rights.

10. Termination

• VKERT may suspend or terminate your account or restrict access to the Site at any time, with or without notice, for conduct that VKERT believes violates these Terms or is harmful to other users or the company.
• Upon termination, you must immediately cease all use of the Site, and VKERT may delete any of your store listings or data associated with your account.

11. Governing Law & Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, U.S.A., without regard to conflict-of-law principles.
• Any dispute arising under these Terms shall be resolved in the state or federal courts located in Pennsylvania, and you consent to the jurisdiction of those courts.
• At VKERT’s discretion, disputes may alternatively be resolved through binding individual arbitration; no class actions are permitted.

12. Changes to Terms

VKERT may modify or update these Terms at any time by posting a revised version on the Site.

Your continued use of the Site after such changes constitutes acceptance of the updated Terms.

The effective date of the most recent revision is listed at the top of this page.

13. Miscellaneous

• Section headings are for convenience only and have no legal effect.
• If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
• You may not assign or transfer your rights under these Terms without VKERT’s written consent. VKERT may assign its rights or obligations without restriction.
